Choosing the right Trust is key

It is crucial to have informed advice on which Trust is best suited to your unique scenario.

Some of the most common types are:

Discretionary Trusts – Discretionary Trusts help preserve assets for example in cases of divorce, care home fees, or potential Inheritance Tax. Beneficiaries do not have a direct right to the Trust fund, making the assets disregarded in financial assessments. However, be aware of potential tax consequences related to Inheritance Tax, Capital Gains Tax, and Income Tax. Proper advice is essential to ensure the benefits outweigh the downsides.

Life Interest Trusts – Life Interest Trusts, or Interest in Possession Trusts, are often used to provide income or residence rights to a person during their lifetime, with the Trust ending upon their death, remarriage, or other specified circumstances. This type of Trust is common in cases of second marriages and protecting a share of the property where the survivor of the two goes into care.

Disabled Persons Trusts – For children with mental or severe physical disabilities, Disabled Persons Trusts can be beneficial. These are specialist trusts and carry a number of tax advantages compared to a Discretionary Trust.
